This page covers the Garner facts that come up in a claim. It names the agency that writes the report, the highways NCDOT lists in town, the emergency departments nearby and the crash count the state published for Garner.
Who writes the report for a crash in Garner?
G.S. 20-166.1 names the Garner Police Department as the agency for a reportable crash inside the town limits. The statute makes the police department of the city or town the agency to notify for a crash in a city or town, and it directs that agency to investigate.
Outside the town line the statute names a different agency. A crash there goes to the State Highway Patrol or the sheriff's office of the county where it happened. A Highway Patrol first sergeant said in a published interview that anything outside city limits typically falls to the Patrol, and he described troopers patrolling the interstates.
The notice rule turns on location. A wreck on I-40 or US 70 just beyond the Garner town line is reported to the Highway Patrol or the Wake County Sheriff's Office, and a wreck on the same road inside the line is reported to the Garner Police Department. That rule does not keep troopers off those roads inside town. G.S. 143B-1716 directs the Highway Patrol to regularly patrol the highways of the State, and a trooper who starts a crash investigation keeps it until another agency takes it over. On I-40 and US 70 inside Garner, the report can come from a trooper or from a Garner officer, and the agency that worked the crash decides where a copy is requested.
Garner does not appear on the state budget office's current list of municipalities that sit in more than one county. A crash inside the town limits is a Wake County crash.
The department's administration office is at 912 7th Ave. and keeps hours Monday to Friday from 8 a.m. to 5 p.m. The guide to getting a Garner crash report covers the department's online database and the NCDMV route for reports a trooper wrote.
Which Garner roads do NCDOT records name?
NCDOT project records name several major routes in Garner. Three of them carry active or planned work, and lane patterns in a work zone shift as a project moves along.
- Toll NC 540 at I-40. NCDOT reports that the North Carolina Turnpike Authority opened the first extension of the Triangle Expressway in September 2024. It runs from the NC 55 Bypass in Apex to the I-40 and I-42 interchange in Garner. The next phase runs from I-40 in Garner to the I-540 and I-87 interchange in Knightdale, and NCDOT anticipates it opening in 2028.
- US 401, also called Fayetteville Road. In April 2026 NCDOT announced a contract to rebuild more than a mile of US 401 in Garner as a six-lane, median-divided road from south of Old Stage Road to south of Mechanical Boulevard. The design removes left turns from side streets and adds Reduced Conflict Intersections. NCDOT reported water line work along Fayetteville Road in August 2026.
- US 70 and NC 50 at Timber Drive. NCDOT lists a project to upgrade the intersection of US 70 and NC 50 with Timber Drive and Hammond Road. NCDOT places it in Garner near the southern edge of Raleigh.
Toll NC 540 is a toll road. G.S. 20-166.1 states its notice rule in terms of whether a crash happened in a city or town, so the same test applies on the toll road.
Photographs of the signs and the lane layout from the day of a work zone crash hold a record of something that will look different a few weeks later.
Where is emergency care for a Garner crash?
WakeMed's Garner Healthplex has what WakeMed calls a 24/7 full-service emergency department for adults and children. WakeMed describes the adult emergency department at its Raleigh Campus as open around the clock and treating major trauma.
Treatment does not end with the emergency visit.
You cannot have delays and gaps in medical treatment. It severely damages the value of your case.
How many crashes did the state count in Garner in 2024?
The 2024 North Carolina Traffic Crash Facts report lists 1,030 crashes in Garner in its city crash data table, with 5 people killed and 394 injured.
The Garner crash statistics page lays out the rest of that table. It also explains why NCDOT's three-year city ranking shows a different total for the town.
What does the other driver's insurer want after a Garner crash?
People believe that the insurance adjuster will do the right thing and protect their interest when in fact the adjuster is hired to pay the injured person as little as possible to settle the claim.
Fault is where that starts in this state. The page on contributory negligence explains the North Carolina fault rule adjusters raise and the doctrine that answers it.
How do Garner clients work with an office in Graham?
The first meeting with a Garner client is by phone or video, and I also meet clients in person. The office is at 110 W. Elm Street in Graham, and I was admitted to practice in North Carolina in 1998.
One of the most important functions of an attorney in a personal injury case is to find all insurance policies that provide coverage in a case. Insurance companies don't all come forward and tender coverage after an accident.
My practice is personal injury from crashes. The page on car crash claims explains that work in more detail, and the Wake County page covers the courthouse where a Wake County civil case is heard.
Reach the office at 336-221-8900 or julian@juliandobylaw.com. The office keeps weekday hours from 8:30 a.m. to 5:00 p.m.
